Welcome to Print Phone Cover. These Terms of Service ("Terms") govern your use of our website at www.printphonecover.com (the "Site") and our custom phone case printing kiosks (the "Services"). By accessing our Site or using our kiosk services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Site or Services.
1. ACCEPTANCE OF TERMS
By using our Services, you represent that:
- You are at least 18 years of age, or have parental/guardian consent
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- All information you provide is accurate and truthful
2. DESCRIPTION OF SERVICE
Print Phone Cover operates self-service kiosks that allow customers to create and print custom phone cases instantly. Our Services include:
- Access to design templates and tools via kiosk interface
- Custom image upload and printing capabilities
- Same-day, in-store phone case production
- Various phone case options for multiple device models
**Important:** We do not sell products online. All purchases must be made in person at our kiosk locations.
3. USE OF KIOSK SERVICES
A. Proper Use
You agree to use our kiosks only for their intended purpose of creating custom phone cases. You must not:
- Damage, vandalize, or tamper with kiosk equipment
- Attempt to bypass payment systems or obtain services without payment
- Use the kiosk in a manner that disrupts other customers
- Upload viruses, malware, or malicious code
- Interfere with the kiosk's operation or security features
B. Kiosk Locations
Our kiosks are located at partner retail locations throughout Texas. Hours of operation depend on the host location's business hours. We are not responsible for the policies, operations, or conditions of our partner locations.
4. INTELLECTUAL PROPERTY AND CONTENT
A. Your Content
When you upload images or create designs using our kiosks ("Your Content"), you represent and warrant that:
- You own all rights to Your Content, or have permission to use it
- Your Content does not infringe on any third-party intellectual property rights
- Your Content does not violate any laws or regulations
- You have obtained all necessary releases and permissions for any recognizable persons in Your Content
B. Prohibited Content
You may NOT upload or print content that:
- Infringes on copyrights, trademarks, or other intellectual property rights
- Contains copyrighted characters, logos, or brand imagery without authorization (Disney, Marvel, NFL, NBA, designer brands, etc.)
- Is obscene, pornographic, or sexually explicit
- Depicts violence, illegal activities, or hate speech
- Violates anyone's privacy or publicity rights
- Is defamatory, harassing, or threatening
- Contains celebrity images or professional photography without proper licensing
C. Our Rights
By using our Services, you grant Print Phone Cover a non-exclusive, royalty-free license to:
- Process and print Your Content as requested
- Store Your Content temporarily during the printing process
- Use anonymized data for service improvement purposes
**We automatically delete Your Content from our systems immediately after printing is complete.**
D. Kiosk Software and Interface
All kiosk software, design templates, user interface, and proprietary technology are owned by Print Phone Cover and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, reproduce, or reverse engineer any part of our systems.
5. PAYMENT AND PRICING
A. Pricing
All prices are displayed on the kiosk screen before purchase. Prices are subject to change without notice. Applicable sales tax will be added to your purchase.
B. Payment Methods
We accept major credit cards, debit cards, and other payment methods as indicated at each kiosk. Payment is processed immediately upon order confirmation.
C. No Refunds
Due to the custom nature of our products, **all sales are final**. Please review our [Refund Policy](https://printphonecover.com/policies/refund-policy) for information about replacements for defective products.
6. PRODUCT QUALITY AND DISCLAIMERS
A. Quality Assurance
We strive to produce high-quality custom phone cases. However:
- Print quality depends on the resolution and quality of images you upload
- Color accuracy may vary slightly due to screen display differences
- We are not responsible for poor results from low-quality images
- You are responsible for previewing and approving your design before printing
B. Case Fit and Protection
While our cases are designed to fit specific phone models:
- You are responsible for selecting the correct phone model at the kiosk
- Cases provide basic protection but are not guaranteed to prevent damage from drops or impacts
- We are not liable for any damage to your phone while using our cases
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
A. Print Phone Cover, its owners, employees, partners, and affiliates shall not be liable for:
- Any indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damage to your phone or other property
- Injuries occurring at kiosk locations
- Service interruptions or kiosk malfunctions
- Defects in third-party products or materials
B. Our total liability for any claim arising from your use of our Services shall not exceed the amount you paid for the specific product or service giving rise to the claim.
C. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Print Phone Cover, its officers, directors, employees, partners, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your use of our Services
- Your Content, including any intellectual property infringement
- Your violation of any third-party rights
- Any illegal or harmful activities conducted using our kiosks
